Terms and conditions

Terms and conditions of Steg & Stadt Handels GmbH, Kölner Straße 214, 40227 Düsseldorf, for orders placed through this website, for collection in a shop (Click & Collect) and for two-hour holds. The German version is the binding one.

1. Scope

These terms apply to all contracts concluded with us through this website, by consumers and by businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (section 13 of the German Civil Code). Differing terms of the customer do not become part of the contract unless we agree to them in writing.

2. Conclusion of contract

The presentation of goods on this website is not a binding offer but an invitation to order. By submitting your order you make a binding offer. We confirm receipt of your order by email without delay; that confirmation is not yet an acceptance. The contract comes into being when we declare acceptance or dispatch the goods, or make them available for collection. We store the text of the contract; the contract language is German.

3. Two-hour holds

A hold is neither a contract of sale nor a binding order. We set one piece aside in the chosen size for two hours from the moment the hold code is issued, at the collection desk of the shop you chose. A hold is free: we ask for no payment and no card details. When the two hours are up the hold ends automatically, the piece is put back on sale, and no cost or obligation of any kind arises for you. A contract of sale only comes into being in the shop, when you decide to keep the piece and pay for it. At most three holds may exist at the same time.

4. Stock figures

The stock figures shown on this website come from a fixed sample dataset that was counted by hand and shipped with the site. They are not live data from a point of sale system and are expressly given as non-binding indications. No claim to the availability of a particular piece in a particular size follows from a stock figure.

5. Prices and delivery costs

All prices are final prices in euro and include statutory VAT. For delivery within Germany we charge €4.90; from an order value of €80 delivery is free. Collection in a shop is free.

6. Payment

The payment methods stated during the order process are available. For collection in a shop you may pay online in advance or on the spot. The statutory rules apply in the event of late payment.

7. Delivery and collection

We deliver within Germany. Delivery normally takes two to five working days from conclusion of the contract. For Click & Collect we email you as soon as your order is ready in the shop you chose, and we keep it there for seven days. If the goods are not collected, we are entitled, after an unsuccessful reminder, to withdraw from the contract and refund any amounts already paid.

8. Retention of title

The goods remain our property until they have been paid for in full.

9. Right of withdrawal

Consumers have a fourteen-day right of withdrawal for contracts concluded online. Details and the model withdrawal form are set out in our withdrawal notice. There is no statutory right of withdrawal for a purchase completed in a shop; even so, we take unworn goods back there within fourteen days on presentation of the receipt.

10. Warranty

Statutory liability for defects applies. If the goods are defective you may first demand subsequent performance; under the statutory conditions you may also reduce the price, withdraw from the contract or claim damages. The limitation period is two years from receipt of the goods.

11. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. Where a material contractual obligation is breached through slight negligence, our liability is limited to the foreseeable damage typical of this type of contract. Liability is otherwise excluded. Liability under the German Product Liability Act remains unaffected.

12. Dispute resolution

The European Commission’s online dispute resolution platform is available at ec.europa.eu/consumers/odr. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

13. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer is habitually resident remain unaffected. Should any provision be ineffective, the remainder of the contract remains effective.
